  1. About this Privacy Policy
    • This privacy policy governs the way Offit Trading Company ACN 633 895 271 (Offit Trading, we, us, our) handles personal information. It applies to all personal information we collect in connection with our website (www.offitapp.com) (Website) and the Offit App.
  2. What is personal information?
    • ‘Personal information’ is information or an opinion about you (whether true or not) that identifies you or from which your identity is reasonably identifiable.
    • The Offit App is designed to provide general information on exercise and fitness, and showcase examples of particular exercises. As part of operating the Offit App and our Website, we may collect and handle certain personal information about you.
  3. Why do we have a privacy policy?
    • We are committed to ensuring your personal information is protected and we believe you have a right to know our practices regarding the information we learn and collect about you.
    • We comply with the Privacy Act 1988 (Cth) (Privacy Act) and the Australian Privacy Principles (APPs), which regulate the collection, use, and disclose personal information.
    • This privacy policy is designed to keep you informed of the ways we collect, manage and disclose your personal information and help you to understand your rights under the Privacy Act.
  4. What kinds of information do we collect about you?
    • We collect information about you that we reasonably need for our business functions and activities, which primarily involve operating the Offit App. For example, in order to set up and administer a user account for you on the Offit App, we will need to collect your name and email address.
    • We may also collect and use your personal information for activities in support of our primary business functions such as processing payments, administration, employment, management, marketing, IT, legal, and customer support.
    • We will never request any ‘sensitive information’ about you, such as health information, or information about your political or religious beliefs.
  5. How do we collect information about you?
    • We generally only collect personal information you provide to us directly. For example:
      • when you submit information via the Offit App or our Website, such as when you sign up for an account with us on the Offit App;
      • when you contact us via telephone, email or send an enquiry or complaint through our Website or the Offit App;
      • in administering and performing any contracts we have with you; and
      • when administering any of our services.
    • If you are subscribed for an account on the Offit App as part of a corporate plan, we may also collect personal information, such as your name and work email address, from your employer.
    • If we collect personal information about you from a third party we will, where appropriate, request that third party inform you that we are holding such information, how we will use and disclose it, and that you may contact us to gain access to, correct, or update the information.
    • If we receive personal information about you that we have not requested, and if we determine that we could not have lawfully collected that information under the Privacy Act if we had requested it, we will destroy or de-identify the information (if it is lawful and reasonable to do so). If we collect your personal information in an unsolicited manner, we will take reasonable steps to inform you of such collection and also how we use, disclose and secure your personal information.
    • Subscription purchases made by individual users of the Offit App are generally made via the relevant app store, such as the iOS App Store or Google Play Store. We will not request or hold any credit card information of, or process any payments directly from, individual users of the Offit App.
  6. Do you need to provide us with your personal information?
    • You do not need to provide us with your personal information. You may deal with us anonymously or by using a pseudonym, if you wish. However, if you choose to deal with us anonymously, there may be certain things we cannot assist you with. For example, we may not be able to give you information about your dealings with us as a customer, supplier, or potential employee.
    • To register for an account on the Offit App, and access the features of the Offit App, you will need to provide us with certain personal information including your name and email address.
  7. Why do we handle your personal information?
    • As a general rule, we only process personal information for purposes set out in this privacy policy or authorised under the Privacy Act. We collect, hold, use and disclose personal information to:
      • provide the Offit App and its functionality to you and other users;
      • administer our dealings with you, communicate with you and provide you with relevant information;
      • assess your needs and preferences so that we can refer you to relevant products and services and improve our service and product offerings;
      • comply with legal and regulatory obligations; and
      • otherwise manage our business.
    • We will not use or disclose your personal information for any other purpose unless you have consented to that use or disclosure.
    • We may disclose your personal information to:
      • our related entities, including Offit App Pty Ltd;
      • your employer, if you are subscribed for an account on the Offit App as part of a corporate plan; and
      • other third parties such as our suppliers, providers of technical and support services, and professional advisors.
    • If we disclose information to a third party, we require that the third party protect your information to the same extent that we do.
  8. How do we manage and protect your personal information?
    • We hold personal information as either physical records, electronically on our intranet system, in cloud storage, and in some cases, records on third party servers, which may be located overseas. We maintain reasonable physical, procedural and technical security for our office and information storage facilities so as to prevent any loss, misuse, unauthorised access, disclosure, or modification of personal information. This also applies to disposal of personal information.
    • From time to time we may engage an overseas recipient to provide services to us, such as cloud-based storage solutions. Please note that the use of overseas service providers to store personal information will not always involve a disclosure of personal information to that overseas provider.  By providing us with your personal information, you consent to the storage of that information on overseas servers and acknowledge that APP 8.1 will not apply to such disclosures. For the avoidance of doubt, in the event that an overseas recipient breaches the APPs, that entity will not be bound by, and you will not be able seek redress under, the Privacy Act.
    • We will destroy or de-identify your personal information once it is no longer needed for a valid purpose or required to be kept by law.
  9. Marketing
    • Like most businesses, we use marketing to promote our business from time to time. We may use your personal information (such as your email address) to provide you with information about products or services we think you may be interested in.
    • If you no longer wish to receive marketing information from us, you can choose to opt out of our marketing emails at any time. You can do so by using the ‘unsubscribe’ function included at the bottom of our marketing emails, or by contacting our Privacy Officer on the details below.
  10. Cookies
    • A cookie is a small text file stored in your computer’s memory or on your hard disk for a pre-defined period of time. We use cookies to identify specific machines in order to collect aggregate information on how visitors are experiencing the Website.  This information will help to better adapt the Website to suit personal requirements.  While cookies allow a computer to be identified, they do not permit any reference to a specific individual.  For information on cookie settings of your internet browser, please refer to your browser’s manual.
  11. How to access and correct your personal information
    • If you have registered for an account on the Offit App, you may view certain information (such as your username), and change your password, by logging in to your account. You may also delete your account on the Offit App at any time. Please note that deleting the Offit App from your mobile device will not automatically delete your account, or erase the personal information we hold about you.
    • If you would like to access, or make a correction to, other types of personal information we hold about you, please contact our Privacy Officer using the contact details below. We respond to all privacy requests within a reasonable time. On the rare occasion that we refuse to grant you access to, or make a correction to, your personal information, we will provide you with written reasons why, including any applicable provisions of the Privacy Act that we rely on.
  12. GDPR
    • If you are a resident of a country that belongs to the European Economic Area, this section 12 applies to you.
    • We are a data controller of your personal information for the purposes of the General Data Protection Regulation 2016/679 (GDPR). Under certain circumstances, the GDPR grants you additional rights in relation to your personal information. In summary, you have the right to:
      • request access to your personal information (known as a data subject access request);
      • request rectification of incomplete or inaccurate personal information that we hold about you;
      • request erasure of your personal information (we must comply unless there is a reason for us to continue to hold and process it);
      • object to the processing of your personal information in certain circumstances, for example, if you feel our processing impacts on your fundamental rights and freedoms;
      • request restriction of processing of your personal information;
      • request the transfer of your personal information to you or to a specific third party; and
      • withdraw your consent if we are relying on consent to process your personal information.
